These Terms of Service apply to all persons using Farm Fresh. The operator of the platform is Gope-Tech.
They govern in particular the use of accounts, store listings, product offers, and favorites features. In addition, other pages such as the Privacy Policy, Legal Notice, or separate notices may apply where they contain more specific provisions for individual subject areas.
Farm Fresh is a technical platform and an intermediary service. Farm Fresh is neither the seller nor the supplier, manufacturer, warehouse operator, or payment processor of the products displayed on the platform.
Contracts for offered products or services are concluded exclusively between the respective users and the respective seller. All pre-contractual information, descriptions, prices, availability, and performance obligations originate from the seller.
Farm Fresh does not guarantee that offers are current, complete, lawful, available at all times, or suitable for a particular purpose.
Accounts may only be created and used by persons who are at least 16 years old and who have the legal capacity required under the applicable law.
Users must provide complete, accurate, and up-to-date information when registering and using the platform and must update such information without delay if changes occur.
Login credentials must be kept confidential and protected against unauthorized access. Users are generally responsible for all activities carried out through their account.
In individual cases, Farm Fresh may request additional information, confirmations, or proof where this appears necessary for verification, misuse prevention, or legal protection.
Sellers are solely responsible for their listings, products, images, prices, availability, descriptions, opening hours, and the legal compliance of their offers.
All information must be truthful, not misleading, and up to date. Sellers must hold all rights, permits, registrations, approvals, and other authorizations required for their offers.
Where applicable, sellers must comply in particular with food law, safety law, labeling law, consumer protection law, tax law, intellectual property law, and all other statutory requirements.
Sellers must ensure that the products they offer are safe and may be offered lawfully.
Farm Fresh may contact store owners or responsible contacts to ask whether they are interested in possible advertising, photo, or video shoots or to coordinate such opportunities. However, such contact does not grant Farm Fresh any right to enter, film, or photograph any person, store, or other property without separate consent.
In particular, the following content and offers are not permitted on Farm Fresh. The following list is not exhaustive:
- illegal goods or services,
- stolen or unlawfully obtained goods,
- counterfeit products or other imitations,
- recalled or obviously unsafe products,
- weapons, where their offering is prohibited or restricted,
- drugs, narcotics, or comparable substances, where their offering is prohibited,
- products lacking the required permits or licenses,
- images, texts, trademarks, or other content that infringe third-party rights,
- misleading statements regarding quality, origin, safety, health effects, certifications, availability, or price,
- fraudulent, hateful, threatening, insulting, obscene, or otherwise unlawful content.
In particular, impersonation, fraud, spam, manipulation, malware, automated or mass scraping of data, circumvention of technical protection measures, and reverse engineering of non-public parts of the platform are prohibited, unless expressly permitted by mandatory law.
Also prohibited is any use that disrupts the operation of the platform, impairs other users, or creates security, integrity, or trust risks.
Users may not circumvent or attempt to circumvent suspensions, removals, visibility restrictions, or other technical limitations.
Users generally retain the rights to the content they upload. However, by uploading or posting content, they grant Farm Fresh a non-exclusive, worldwide, royalty-free license to host, store, reproduce, technically process, format, display, distribute, and use such content insofar as this is necessary or reasonable for the operation, improvement, promotion, and marketing of the service.
This includes, in particular, image material of stores uploaded to or published on the platform, including use for internal purposes and for Farm Fresh advertising, presentations, and other marketing purposes.
This license applies for the duration of the availability of the respective content on the platform and for a reasonable subsequent period where required for backups, technical transitions, or statutory retention and documentation obligations.
Users warrant that they hold all rights necessary to upload content and to validly grant the foregoing license.
Farm Fresh may review, hide, restrict, remove, or delete listings and other content, and may suspend or terminate accounts where there are legal risks, security risks, indicators of fraud, repeated violations, complaints, notices from rights holders, or other concerns regarding integrity and trust.
In urgent or serious cases, Farm Fresh is not required to provide prior warning or grant a remedy period.
Whether content or accounts are restored is decided by Farm Fresh at its own discretion. There is no entitlement to prior warning, reinstatement, or any specific response period.
Farm Fresh is provided on an "as available" basis. Temporary outages, interruptions, delays, or technical errors may occur.
Farm Fresh is not responsible for third-party content, statements made by sellers, external links, or transactions, contacts, and agreements that take place outside the platform or solely between users.
Farm Fresh's liability is limited to the extent permitted by law. This does not affect cases in which a limitation of liability is not legally permitted.
The processing of personal data is additionally governed by the applicable Privacy Policy.
Information about the operator, contact options, and other mandatory legal information may additionally be provided through the Legal Notice, contact page, or other legal information pages.
Where provisions of these Terms of Service and a more specific policy or information page differ only for a narrowly defined subject area, the more specific provision shall prevail for that subject area.
These Terms of Service may be amended at any time with effect for the future. The current version is always available

To the extent permitted by applicable law, continued use of Farm Fresh after publication of an updated version shall be deemed acceptance of the amended terms.
Users who do not agree with an amended version must stop using Farm Fresh and may request deletion of their account where applicable.
